With the economic liberalization and the fast moving economic reforms in India in the 90s, India had opened its economy to the world and had adopted the free market principle regime. Indian market had recognized the benefits of competitive markets to promote economic development and consumer welfare. The competition law was recognized as a key pillar of a market economy. This resulted in India replacing its archaic Monopolies and Restrictive Practices Act, 1969, with a modern competition law in the form of the new Competition Act, 2002 (the “Act”). The Act is in sync with the modern and internationally established competition law principles.

The Act was introduced to prevent any appreciable adverse effect on competition by regulating anti-competitive agreements and combinations. The Act constituted the Competition Commission of India (“CCI“), a regulatory authority, to look into the violations of the Act and to ensure healthy market competition.

It has become imperative that the companies adopt non-offensive competitive practices aligned with their business objectives and the market strategies.
